These terms apply when you use fooddirect.net: the venue directory, ordering from a venue's menu, and the services we provide to venues. Please read them. By using the site you agree to them. If you don't agree, please don't use it.
1. Who we are
FoodDirect is run by David Herbert, a sole trader trading as FoodDirect, in the United Kingdom. Email: [email protected]. "We", "us" and "FoodDirect" mean David Herbert trading as FoodDirect. "You" means whoever is using the site, whether a customer or a venue.
2. If you're ordering food
- Your order is with the venue, not with us. When you order or book through a venue's menu (like yourvenue.fooddirect.net), the contract is between you and the venue. The venue sets its prices, cooks and delivers your food, takes your payment and handles refunds and complaints. FoodDirect provides the technology that passes your order to them.
- Allergies: allergen and dietary information on a menu comes from the venue. If you have an allergy, always check with the venue before you order or eat.
- Problems with an order: contact the venue first. Their details are at the bottom of their menu. Your rights under consumer law, for example if food isn't as described, are against the venue, and nothing in these terms takes them away.
- Age-restricted items: the venue may ask for ID when you collect or receive alcohol or other age-restricted items, and may refuse to supply them.
- Event tickets and private parties: tickets and party bookings are with the venue too. The venue decides whether you can cancel and get your money back, and it says which before you book. If the venue cancels an event, it's for the venue to refund you.
3. The directory
The directory helps you find local food businesses and places to stay. Its information comes from OpenStreetMap (© OpenStreetMap contributors, available under the Open Database Licence), Food Standards Agency hygiene ratings, and the venues themselves. We do our best to keep it accurate, but opening hours, menus and details change. Check with the venue if something matters to you. Use Report a problem on a listing to tell us about a mistake.
Normally the directory shows venues nearest to you first. Venues with Featured Ranking are shown above the others near them, marked ★ Featured. That's the only way a venue can pay to change where it appears.
4. If you run a venue
What we provide
Hosting your venue on FoodDirect is free: a listing in the directory, your own fooddirect.net address, a menu customers can order from, and the emails we send for you. The FoodDirectPos till software has its own terms, in its user guide.
What you're responsible for
- The accuracy of everything you publish: your business details, menu, prices, allergen information and photos. You must have the right to use any photos and text you upload.
- Selling lawfully. That includes food hygiene and allergen rules, alcohol and age-restricted sales, consumer law, pricing and VAT.
- Your customers' orders, payments, refunds and complaints.
- Using your customers' personal information lawfully, including telling them how you use it, and only sending marketing emails to customers who agreed to them.
- Keeping your sign-in links, recovery code and till secure.
Things you mustn't do
Don't publish anything unlawful, misleading, offensive or that belongs to someone else. Don't pretend to be a venue you don't run, and don't try to get around the site's security or interfere with it. We may remove content or suspend a venue that breaks these terms. Where it's reasonable, we'll tell you first and give you a chance to put it right.
Customers' personal information
When customers order from your menu, you are the controller of their personal information and FoodDirect is your processor. We will:
- use it only to pass orders and bookings to your till and to send the emails you've set up, following your instructions as set out in these terms and your settings;
- not keep copies of orders on our server, and not use your customers' information for anything of our own;
- make sure anyone handling it is bound to keep it confidential, and keep it secure;
- use only the services listed in our privacy policy to do this, and tell you before adding new ones that would handle it;
- help you respond to customers who ask about their information, and tell you without undue delay if we become aware of a breach affecting it;
- delete it when we no longer need it to provide the service, and give you the information you need to show you're complying with the law.
5. Featured Ranking
- Featured Ranking costs £15 for 90 days, paid in advance by card through Stripe. The price shown before you pay is the price you pay. Venues using FoodDirectPos buy it from the till (Admin → Optional Extras); other listed venues buy it when signed in at fooddirect.net/owner. If you start using FoodDirectPos later, any time you have left moves to your till.
- It starts as soon as your payment goes through and lasts 90 days. If you buy it again before it ends, the new 90 days are added to the time you have left. It doesn't renew by itself; we email you a week before it ends, and it's up to you whether to buy another 90 days.
- Your venue is shown above the ordinary listings for customers near you (within about 10 km, or searching your town or postcode). When several venues near a customer are featured, they take turns at the top, so every featured venue gets the top spot equally often. We don't promise any particular number of views or orders.
- It's bought by businesses for business use, so the 14-day cooling-off period for consumers doesn't apply. Once it's running it can't be cancelled for a refund. If we stop providing it before your 90 days are up, we'll refund the days left. We won't refund them if we've removed your venue for breaking these terms.
- We may change the price or how Featured Ranking works in future, but not for a period you've already paid for.
6. Your own web address
- Venues using FoodDirectPos can have their menu at an address on their own domain, for example order.yourbusiness.co.uk, as well as at their fooddirect.net address. It's free, and it's set up from the till (Admin → Optional Extras). One address per venue.
- If we ever decide to charge for it, we'll email you at least 30 days before, and you won't be charged anything unless you choose to pay.
- You need to own or control the domain, keep it registered, and add the DNS record the till shows you. We set up and renew the secure certificate. If the record is missing for 30 days (never added, or removed later), we remove the address and your menu carries on at your fooddirect.net address. You can set it up again any time.
- You can change to a different address, or stop using it, at any time from the till. When you change, your current address keeps working until the new one is live.
- QR codes and links made with your own address only work while you have it, so if you stop, any you've printed with it will need replacing. Ones with your fooddirect.net address keep working.
- We can stop providing own web addresses. If we do, we'll email you at least 30 days before, and your fooddirect.net address keeps working.
7. Menus & Flyers
- Venues using FoodDirectPos can make print-ready table menus, flyers and table tent cards, and pictures for social media, from their menu in the till (Admin → Menus & Flyers). Anyone can see a preview, marked SAMPLE. Downloading them without the mark, as PDFs or pictures, costs £10 a year, paid in advance by card through Stripe. The price shown before you pay is the price you pay.
- It renews automatically each year until you cancel. Cancel any time from the till (Manage subscription); it keeps working to the end of the year you've paid for, and you won't be charged again. If a renewal payment fails, Stripe tries again for a short while before it stops.
- Download as many designs as you like, as often as you like, while it's running. What you've downloaded is yours to print and use for your venue, including after it ends.
- The designs use the prices, descriptions, photos and allergen information from your till, and any wording you add. You're responsible for checking them before you print or use them, for any offer you advertise, and for the information you give customers about allergens, including if you choose to leave allergen numbers off. Only use photos and logos you have the right to use.
- It's bought by businesses for business use, so the 14-day cooling-off period for consumers doesn't apply, and a year that's started isn't refunded. If we stop providing Menus & Flyers, we'll refund the unused part of your year.
- We may change the price or the designs in future. A price change won't apply until your next renewal, and we'll email you at least 30 days before it does.
8. Events
- Venues using FoodDirectPos can sell tickets for their events on the till and on their menu site, keep a guest list, and take private party enquiries and deposits (Admin → Events). Anyone can set events up; putting tickets on sale costs £10 a year, paid in advance by card through Stripe. The price shown before you pay is the price you pay. We don't take anything from the tickets you sell.
- It renews automatically each year until you cancel. Cancel any time from the till (Manage subscription); it keeps working to the end of the year you've paid for, and you won't be charged again. If a renewal payment fails, Stripe tries again for a short while before it stops. When it ends, your guest lists stay on your till and you can still check people in and refund them, but you can't sell more tickets.
- Your customers' tickets and party bookings are between them and you. Money from online sales goes to your own Stripe account. You set your refund rule, and you're responsible for keeping to it, for refunding people if you cancel, and for your events themselves (licences, safety, capacity and age limits).
- The guest list is kept on your till. Ticket, reminder and cancellation emails are sent through our server on your behalf, as order emails are.
- It's bought by businesses for business use, so the 14-day cooling-off period for consumers doesn't apply, and a year that's started isn't refunded. If we stop providing Events, we'll refund the unused part of your year.
- We may change the price in future. A price change won't apply until your next renewal, and we'll email you at least 30 days before it does.
9. Keeping the site running
We work hard to keep fooddirect.net available, but we can't promise it will always work without interruption, for example during maintenance, or if the internet or a service we rely on fails. Ordering also needs the venue's till to be switched on and online. We may change, add or remove features. If we decide to close the service for venues, we'll give them at least 30 days' notice by email, unless we're forced to act sooner.
10. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. If you're a consumer, nothing in these terms affects your legal rights.
- We aren't responsible for venues: their food, service, prices, information or what they do with your order. That's between you and the venue.
- For venues: we aren't liable for loss of profits, sales, business or data, or for indirect losses. Our total liability to a venue in any 12 months is limited to the amount it paid us in those 12 months, or £100, whichever is higher.
11. Who owns what
FoodDirect owns the site, its design and its software. Venues own their own content and give us permission to publish it on fooddirect.net, and in search results and links to it, while they're listed. Directory information from OpenStreetMap is © OpenStreetMap contributors.
12. Changes to these terms
We may update these terms. The current version is always on this page, and the date at the bottom shows when it last changed. If a change significantly affects venues, we'll email them at least 30 days before it takes effect. Using the site after a change means you accept it.
13. The law
These terms are governed by the law of the United Kingdom: the law of England and Wales, Scotland or Northern Ireland, whichever applies where you live or your business is based, and the courts there can hear any dispute. If something goes wrong, please email [email protected] first. Most things can be sorted out quickly.
